DivHard PlayerPublic player tool

Terms and conditions

These terms are the rules for using DivHard Player. The service is a public tool. It is not a membership site, and it does not create an account for you.

The service

You give the service an address. It returns a player for that address. You choose the address. The service does not choose the media, and it does not review the address before the player link is made.

The media belongs to whoever owns it. A player link is not a license, a sale, or a statement that the media may be copied or shown. Playback can pass through this website because you asked for a player. That request is yours.

The file itself stays on the site that hosts it. Removing a player link here does not delete that file from the other site.

No accounts

There is no registration. The operator cannot open an account for you, identify you as a customer, or ban a customer, because there is no customer account. Anyone who can open the site can use the tool.

What the operator can do is stop an address. If a report identifies a player link, or the address that was used to create it, the operator can refuse new player links for that address and stop player links that were already created for it.

Your responsibility

You use this service on your own responsibility. You are responsible for the address you submit, for creating a player link, for embedding or sharing that link, and for what you do with the playback.

The operator is not responsible for how you use the service or for the behavior of people who use it. The operator does not adopt your address, your player link, or your purpose as its own.

Submit an address only when you have the right to play it and to ask this service for a player. If you do not have that right, do not submit it.

Reports that can involve you or this service

A player link can draw a complaint even though you chose the address. These are the kinds of report this service is built to receive. You, not the operator, are the person who decided to use the address.

  • Copyright. A rights holder can say that a player performs, copies, or makes available a work they own. Playback through this website can be part of that claim. The operator will stop an address that a proper notice identifies. The operator does not claim the safe-harbor registration of a U.S. Copyright Office agent on this page.
  • The same work again. An address that has been removed stays removed. Sending it again does not create a new right to play it here.
  • A restriction on the file. Some files are offered only on their own site, or only to certain people. You may not use this service to play an address you are not allowed to play.
  • Trademark. A name, logo, or title you attach to a player can be reported as someone else's mark.
  • Privacy. A private, unlisted, or personal recording can be reported, including a recording that shows a home, a child in an ordinary family setting, an identity document, or other personal information.
  • Publicity. A person can report the use of their face, name, or voice when they did not allow that use.
  • Reputation. A person can report a player that they say is false and harmful to them.
  • Intimate images. A person can report sexual or nude images that were shared without the consent of the person shown.
  • Anyone under 18 in a sexual image. That is illegal. It is not covered by the responsibility clause above. The address will be removed, and the operator may report it to the authorities. Do not submit the image itself.
  • Fraud and other crimes. A player link used to deceive, threaten, or commit another crime can be reported and removed.
  • A notice from outside the United States. A copyright, privacy, or other lawful complaint from another country can be sent on the DMCA page. The same removal applies when the address can be identified.

Stopping the address here limits further playback through this service. It does not decide the dispute, and it does not remove the file from the site that hosts it. The person who owns the file may also need to contact that site.

Removal

Send the report from the DMCA page. Include the player link or the address that was used to create it. When that address can be recognized, the operator stops serving it. There is still no user to suspend.

A short technical copy used to speed up playback is dropped when the removed address can be matched to it.

No warranty

The service is provided as it runs. Playback can fail, change, or stop. An address can be removed without notice to the person who created the player link. The operator does not promise that a player link will keep working, or that the service is fit for a particular purpose.

Liability

To the extent the law allows, the operator is not liable for loss that comes from your use of the service, from an address you submit, or from a player link you share. This does not limit liability that the law does not allow to be limited, and it does not limit the operator's duty to remove an illegal address once the operator can identify it.

Your duty to cover a claim

If a claim is made against the operator because of an address you submitted, a player link you created or shared, or the way you used the service, you will cover the operator's resulting loss and reasonable cost of responding, to the extent the law allows. This includes a copyright claim, a privacy claim, and the other reports listed above.

Changes

The operator can update these terms by posting a new version on this page. Using the service after that version is posted means you accept it. The date at the bottom of this page is the date of the current version.
